The agreement
These Terms of Service (“Terms”) are an agreement between you and [Company legal name] (“we”, “us”), the company behind Wyspio. By creating an account or using Wyspio you agree to these Terms, our Privacy Policy and our Community Guidelines. If you don't agree, please don't use the service.
These Terms take effect on [effective date].
Who can use Wyspio
- You must be at least 13 years old. Some countries set a higher minimum age for using social apps or for consenting to data processing (for example 14, 15 or 16 in parts of the EU). If that applies where you live, you need to meet that age, or have a parent's or guardian's consent where the law allows it.
- If you're under the age of majority where you live, your parent or guardian must agree to these Terms for you.
- You can't use Wyspio if we've banned you before, or if the law forbids you from using it.
- One person, one account. Accounts are personal, so don't share, sell or transfer them.
Your account
You can sign in with ChatGPT, an email code, or another provider we offer. You're responsible for what happens under your account, so keep your sign-in methods secure and tell us at [contact email] if you think someone else got in.
Your username and profile must not impersonate anyone or mislead people about who you are. We may reclaim usernames that are inactive, infringe someone's rights or break the guidelines.
Your wysps and what you own
A wysp is the animated, interactive card you post. You keep whatever rights you have in your prompts, captions, comments and messages, and in the wysps you publish (to the extent AI output can be owned where you live).
To run the service you give us a worldwide, non-exclusive, royalty-free licence to host, store, process, render (including generating preview thumbnails), and show your content to the audience you choose, for as long as the content is on Wyspio. This licence ends when your content is deleted or expires, except for copies we must keep for safety, legal or backup reasons as described in the Privacy Policy.
Remixing. If you leave “allow remix” on, people who can see your wysp may create their own version of it; remixes link back to you. Turn it off per wysp any time before posting.
You promise that you have the rights to what you post and that it doesn't break these Terms, the guidelines or the law.
AI generation
Wyspio turns what you type into a wysp using AI models from third-party providers. To do that we send your prompt (and, when you refine a wysp, its current version) to the provider that generates it (see which providers).
- AI output can be wrong, weird or not what you meant. Look at the preview before you post: you're responsible for what you publish.
- Every wysp is labelled as made with AI. Don't try to hide or remove that label.
- If you connect your own ChatGPT plan or OpenRouter key, generations run on that account and are also subject to that provider's terms and limits. You can disconnect in Settings at any time.
- Free generations on our own AI keys have daily limits. Don't try to get around them (for example with multiple accounts or automation).
Wysps disappear
Wysps expire after the time you pick (1, 6 or 24 hours) and are then deleted from the service. That makes Wyspio a bad place to store anything you want to keep. It isn't a backup service. Remember that the people who see a wysp can still screenshot or record it.
Acceptable use
Follow the Community Guidelines. In addition, you must not:
- try to break out of the wysp sandbox, attack, probe or overload our systems, or bypass security, rate limits or quotas;
- publish code meant to track, phish, mine crypto, or otherwise harm people who view it;
- scrape the service, create accounts automatically, or run bots without our written permission;
- use Wyspio to break the law or to infringe anyone's rights (including copyright, trademark and privacy);
- sell, rent or misuse anything you learn about other people on Wyspio.
Reports, removals and bans
Anyone can report a wysp. Our team reviews reports and may remove content, limit features, or suspend or ban accounts that break these Terms or the guidelines, usually after a review, and immediately when someone's safety is at risk. We may also report illegal content to the authorities where the law requires it.
If you think we got a decision wrong, email [contact email] with your username and what happened. A person will look at it again.
Third-party services
Wyspio works with services we don't control, for example sign-in providers (OpenAI / ChatGPT, Google) and AI providers (OpenAI, OpenRouter, Google). Your use of those services is governed by their own terms and privacy policies, and we aren't responsible for them.
Beta software
Wyspio is in beta. Features will change, some will disappear, and things will occasionally break. We may change or stop the service (or part of it) at any time; if we shut the service down we'll try to give you reasonable notice.
Disclaimers
To the extent the law allows, Wyspio is provided “as is” and “as available”, without warranties of any kind, including that it will be uninterrupted, error-free, or that AI output will be accurate or suitable. Content on Wyspio is created by users and AI models, not by us, and doesn't reflect our views.
Limitation of liability
To the extent the law allows, [Company legal name] won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Wyspio. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or [amount].
Nothing in these Terms limits liability that can't be limited by law, or your statutory rights as a consumer.
Leaving Wyspio
You can delete your account any time in Settings → Delete account. That removes your profile, wysps, comments, reactions and messages as described in the Privacy Policy. We may suspend or close accounts that break these Terms. Sections that by their nature should survive (like ownership, disclaimers and liability) survive.
Changes to these terms
We may update these Terms as Wyspio grows. For important changes we'll tell you in the app or by email before they apply. If you keep using Wyspio after that, you accept the new Terms.
Governing law
These Terms are governed by the laws of [jurisdiction], and disputes will be handled by the courts of [jurisdiction], unless the consumer laws of the country you live in give you the right to use your local courts and laws.
